The Board seeks enforcement of its order finding Section 8(a)(3) and (1) violations by the Employer and ordering reinstatement with back pay of certain employees. The Employers main argument here as before the Board is that the 8(a)(3) finding is erroneous since the employees concerned were supervisors within the meaning of § 2(11) of the Act and therefore not within the protective language of § 8(a)(3). The Employer also argues that the Boards previous ruling in a certification proceeding decided this issue making relitigation of the question in this proceeding improper.
