Having concluded that Southern Foods, Inc. violated the National Labor Relations Act § 8 (a)(1), (5) by refusing to bargain with the Union which had been certified as the exclusive bargaining agent of its employees, the National Labor Relations Board ordered the Company to cease and desist from the unfair labor practices, to bargain with the Union upon request, and to post appropriate notices. Because we find that the Board improperly certified the Union, enforcement of the order is denied.
